In regards to what McGrady did, his dad mentions it when he came to visit him early on in the season. Here's the video on youtube:

His dad says something like "All you did was drive a car." I guess that means he stole a car or drove one despite not having a license and being too young and got pulled over. Maybe a cop or somebody caught him. That is possible, considering it's Panama and they'll pretty much throw you in prison for anything there.
Also in regards to season 4, there's an interview with Amaury Nolasco who plays Sucre. You can find it here:

He confirms there is a season 4 and they will begin filming in May. So it looks like we are getting a season 4. It also looks like the Sona storyline will continue, obviously with Sucre still being apart of the show.
